Terms of use
These terms apply to the Empty Pockets account, the websites emptypockets.eu and wanderway.emptypockets.eu and the Wander Way mobile app. The operator is [company name] s.r.o., company ID [·], registered office [address], entered in the Commercial Register kept by the [Regional / Municipal] Court in [·], section C, file [·] ("we", "the operator"), contact info@emptypockets.eu. This e-mail is also our single point of contact under the Digital Services Act (DSA); we communicate in Czech and English. By using the service you agree to these terms; if you do not agree, please do not use it.
1. Purpose of the service
Wander Way is for discovering interesting natural, cultural and unusual places, planning routes and meeting other explorers. Places are contributed and moderated by us and by other users; the information shown is for guidance only and may not always be accurate, complete or up to date.
2. Account
You can browse places without an account. Some features (check-ins, friends, events, routes, notifications) need an Empty Pockets account, which also works on our websites. You must be at least 15 years old to create an account. Keep your sign-in details to yourself and enter truthful information. You can delete your account at any time in the app or at emptypockets.eu/account.
3. Personal data
Your account, profile and activity (check-ins, favourites, ratings, routes, events, friends) are stored on our servers so they work across devices and on the web. Check-ins are visible to your friends; your profile is visible to others only if you make it public. We do not sell your data or use it for advertising. Details are in the privacy policy.
4. Location
To show places near you, sort them by distance and let you check in, the app uses your device location, including precise location. If you turn on nearby-place alerts, it also uses location in the background. Location is processed on your device; we do not upload your position or movement. Only what you choose to save (a check-in, an event, a route) is stored.
5. Content you submit
When you suggest a place, report an error, create an event or a route, or upload a photo, you are responsible for having the right to share it and for it not breaking the law or the rights of others.
Your content remains yours. You grant us a free, non-exclusive, worldwide licence for the full term of the economic rights to store, display, reproduce and edit it (for example shorten a text, crop a photo or correct details), include it in the catalogue and, to the extent necessary, make it available to the providers who run the service for us. We are not obliged to use it. Content that has become part of the catalogue of places (suggested places and corrections and photos added to places) may stay there after you delete your account, without any data about you. Section 10 describes how we handle inappropriate content.
6. App, catalogue and intellectual property
The app, the websites, the catalogue of places and their texts, photos, graphics and source code belong to the operator or its licensors and are protected by copyright. Content you submit remains yours; section 5 applies to it.
We grant you a free, non-exclusive and non-transferable licence to use the app and the websites for your own personal, non-commercial purposes, on devices you own or control. The licence applies as long as you follow these terms. Without our written consent you must not:
- bulk download, copy or extract the catalogue of places or a substantial part of it (for example by scraping, other automated tools or by calling our interfaces outside the app and the websites), or republish or sell it;
- modify or decompile the app or otherwise examine its source code, except where the law expressly allows it;
- circumvent or interfere with the security or limits of the service, deliberately overload it or access other users' data;
- rent, sell or sublicense the app or the service, or use it to build a competing service.
We have made a substantial investment in obtaining and verifying the catalogue of places, so it is also protected by the sui generis database right (Section 88 et seq. of the Czech Copyright Act). Normal use, such as browsing places or sharing a link to a place or route with friends, is of course fine.
Do not use the Empty Pockets and Wander Way names and logos in a way that suggests a service is ours or that you work with us. The app also contains third-party open-source software, which is subject to its own licences; you can find the list and the licence texts in the app under Settings → Licences and data sources.
If you obtained the app from the App Store or Google Play, you enter into these terms with the operator, not with Apple or Google, and the operator is responsible for the app. The rules of the store you downloaded the app from also apply, and for the App Store also Apple's Standard End User License Agreement.
7. Community and events
Be respectful to other users. Harassment, spam, impersonation and illegal content are not allowed. Events are organised by users, not by us; the organiser is responsible for the event, and you take part at your own risk. Respect the age limits set for events.
8. Urbex and entry at your own risk
Showing locations in the "Urbex" category is optional and off by default. Visiting abandoned or unsecured places can be dangerous and in some cases illegal (trespassing). Everything you do is exclusively at your own risk and responsibility. Follow the rule "take nothing, leave nothing, break nothing".
9. Protecting nature and on-site behaviour
Respect nature, protected areas, private land and local rules. Do not leave litter behind and be considerate of your surroundings and other visitors.
10. Content moderation and account restrictions
You can report illegal content or content that breaks these terms in the app (report a place, route or event) or by e-mail to info@emptypockets.eu. Tell us what the content is, where we can find it and why you consider it illegal or inappropriate. Reports are assessed by a person. We use an automated tool only to pre-sort reports by urgency and to detect spam; it does not decide on removing content or restricting accounts.
We may remove or hide content that is illegal, false, dangerous, offensive or against these terms. We may temporarily restrict or cancel an account that seriously or repeatedly breaks these terms. When we do so, we will tell you why, unless the law prohibits it or the content is bulk spam. If you disagree with the decision, write to us and we will review it again; this does not affect your right to go to court. You can stop using the service and delete your account at any time.
11. Limitation of liability
We provide the service free of charge and "as is"; we do not guarantee that it will always be available or error-free. Information about places, routes and events is for guidance only and partly comes from users, so check the current condition, accessibility and safety of a place before you visit. We are not liable for damage caused by information being inaccurate, incomplete or out of date, for the condition and safety of the places shown or for events organised by users.
This does not affect our liability that cannot be excluded or limited by law, in particular for harm to health and for damage caused intentionally or by gross negligence, nor your statutory consumer rights.
12. Changes and governing law
We may reasonably change these terms, for example because of a new feature, a change in the law or for security reasons. We will inform you about a significant change in the app or by e-mail at least 14 days in advance and ask for your renewed consent. If you do not agree with the change, you can delete your account before it takes effect or at any time later and thereby end the contract; this costs you nothing. These terms are governed by Czech law; this does not deprive you of the protection of the mandatory laws of the country where you live. If a dispute between us cannot be resolved by agreement, you as a consumer can use out-of-court dispute resolution at the Czech Trade Inspection Authority (adr.coi.cz).
